Welcome to Bright Futures Tutoring. These Terms and Conditions ("Terms") govern your use of our website and your enrollment in tutoring services provided by Bright Futures Tutoring LLC ("Bright Futures," "we," "us," or "our"), a Minnesota limited liability company. By enrolling in services, signing an enrollment form, or using our website, you ("Client," "Parent," or "Guardian") agree to these Terms on behalf of yourself and the enrolled student.

Please read these Terms carefully. If you have any questions, contact us at info@mybrightfuturestutoring.com or 612-208-9022 before enrolling.

 

1. Services

Bright Futures Tutoring provides personalized, one-on-one and small-group academic tutoring for students in grades K–12, including:

  • Academic tutoring in core subjects

  • Test preparation (ACT, SAT, and other standardized tests)

  • College essay writing support

 

Sessions are available in the following formats:

  • In-office sessions at our Maple Grove / Plymouth, MN location

  • Online sessions via video platform

 

Bright Futures reserves the right to assign or reassign tutors at any time based on availability and the best match for the student's needs. We do not currently offer in-home tutoring sessions.

 

2. Enrollment & Account Access

Enrollment is completed by a parent or legal guardian on behalf of the student. By enrolling, you confirm that:

  • You are the student's legal parent or guardian and are authorized to enroll them in tutoring services.

  • You consent to Bright Futures Tutoring LLC providing academic tutoring services directly to the student.

  • All information provided during enrollment is accurate and complete.

 

Upon enrollment, the Client will receive access to a personal account through our scheduling platform (Teachworks). Through this account, you may:

  • Book and manage sessions directly with instructors matched to your student's subject, grade level, and goals

  • View upcoming and past session history

  • Receive invoices and manage billing preferences

  • Access session notes and progress updates

 

Account credentials are personal and should not be shared. Clients are responsible for maintaining the security of their account login information.

 

3. Cancellation & Rescheduling Policy

24-Hour Notice Requirement

Clients must provide at least 24 hours' written or verbal notice to cancel or reschedule any scheduled tutoring session. The time Bright Futures or the assigned tutor receives the notice determines whether this requirement has been met.

 

  • 24+ hours' notice: No charge. The session may be rescheduled or canceled at no cost.

  • Less than 24 hours' notice: The full session fee will be charged.

  • No-show / no notice: The full session fee will be charged.

 

Compassion Exceptions

The late-cancellation fee may be waived at Bright Futures' sole discretion in the following circumstances:

  • Illness or injury affecting the Student or an immediate family member

  • Unexpected family emergency

  • Last-minute school closure or mandatory school event the family could not have anticipated

  • Severe weather making travel unsafe

  • First-time courtesy waiver — one-time, at our discretion, no reason required

 

Compassion exceptions are reviewed individually. We ask that you notify us as soon as possible — open communication is always appreciated.

 

Repeated Late Cancellations

Compassion exceptions are intended for occasional, unavoidable circumstances. If late cancellations become a recurring pattern, Bright Futures reserves the right to require session prepayment or to discontinue services with reasonable notice.

 

4. Billing & Automatic Monthly Payments

No Contracts — Month-to-Month Services

Bright Futures operates on a flexible, month-to-month basis. There are no long-term contracts or commitments. Clients may discontinue services at any time with 7 days' written notice (see Section 24: Termination).

 

Session Rates

Tutoring session rates are confirmed in writing at the time of enrollment and may vary based on subject, tutor experience level, and session format. Rates are subject to change with 30 days' written notice to the Client.

 

Automatic Monthly Billing Authorization

By enrolling, the Client authorizes Bright Futures Tutoring LLC to automatically charge the payment method on file on a monthly basis for all tutoring sessions completed during the prior calendar month, including any applicable late-cancellation fees.

 

  • Billing cycle: Invoices are generated on the 1st of each month reflecting all sessions completed in the prior calendar month.

  • Payment date: Automatic payment is processed on or around the 5th of each month.

  • Late-cancellation fees: Any applicable fees are included in the monthly invoice.

  • Accepted payment methods: Credit card, debit card. A valid payment method must remain on file to maintain active enrollment.

  • Invoices: Sent to the Client's email on file. Please notify us promptly of any billing discrepancies.

 

Failed Payments

If a payment is declined, Bright Futures will notify the Client promptly. Sessions may be paused until the outstanding balance is resolved. Accounts unpaid after 15 days may incur a $25 late fee or result in suspension of services.

 

Refunds

Because billing is based on sessions already completed, refunds are not issued for completed sessions. Any prepaid, unused session credits will be refunded upon termination of services, minus any outstanding balances.

 

5. Student Progress & Communication

Bright Futures is committed to supporting every student's academic growth. As part of our services:

  • Tutors document session notes and progress after each appointment.

  • Clients may request a progress update from their tutor or Bright Futures staff at any time.

  • For students working toward specific goals (e.g., ACT score improvement, grade recovery, college essays), Bright Futures will work with the family to monitor results and adjust the approach as needed.

 

Bright Futures communicates primarily with parents or legal guardians regarding scheduling, billing, and student progress. Communication with minor students may occur when appropriate for scheduling or educational purposes, but parents remain the primary point of contact unless otherwise agreed in writing.

 

It is the Client's responsibility to keep contact information current and to check communications in a timely manner.

 

6. Tutor Matching & Reassignment

Bright Futures takes care in matching each student with a tutor based on subject expertise, grade level, learning style, and availability. We reserve the right to reassign a tutor at any time due to availability changes, tutor turnover, or to better serve the student's needs. We will communicate any tutor change to the Client promptly.

 

Bright Futures cannot guarantee the continued availability of any individual tutor. In the event a tutor is unavailable, we will work promptly to identify a qualified replacement and notify the Client as soon as possible.

 

7. Student Code of Conduct

Bright Futures expects all students to engage respectfully with tutors and staff. Behavior that is disruptive, disrespectful, or unsafe will not be tolerated. Bright Futures reserves the right to:

  • Issue a warning for a first conduct concern

  • Suspend services pending a conversation with the parent or guardian

  • Discontinue services permanently, with a prorated refund where applicable, for repeated or serious conduct issues

 

8. Student Privacy & Confidentiality

Bright Futures treats all student information — including academic records, test scores, session notes, and personal communications — as confidential. We will not share student information with third parties without written consent from the parent or guardian, except as required by law.

 

By enrolling, the Client consents to Bright Futures collecting and using student information (including academic records and test scores shared by the family) solely for the purpose of providing and improving tutoring services.

 

Emergency contact and authorized pickup information collected at enrollment will be used solely for the safety of the student while in Bright Futures' care.

 

9. Late Pickup Policy

For students attending in-office sessions, Bright Futures asks that a parent, guardian, or authorized pickup person arrive promptly at the end of each session. The following policy applies to late pickup:

 

  • 0–10 minutes late: Grace period — no charge.

  • 11–30 minutes late: A $25 flat fee will be added to the next monthly invoice.

  • 30+ minutes late: A $50 flat fee will be added to the next monthly invoice. Bright Futures reserves the right to contact the emergency contact on file if the primary parent or guardian cannot be reached.

 

If a student is not picked up within a reasonable time and Bright Futures is unable to reach the parent, guardian, or any authorized pickup person, we reserve the right to contact local authorities for the safety of the student.

 

If late pickup becomes a recurring pattern, Bright Futures may require the family to adjust their session end time or may discontinue in-office services.

 

Late pickup fees are added to the Client's next monthly invoice consistent with our standard billing cycle.

 

10. Student Safety & Supervision

Bright Futures Tutoring is committed to the safety and well-being of every student in our care. The following supervision guidelines apply to all in-office sessions:

 

  • Supervision start: Bright Futures' supervision of the student begins only at the scheduled session start time.

  • Supervision end: Supervision ends when the session concludes. Please ensure prompt pickup in accordance with our Late Pickup Policy (Section 9).

  • Early drop-off: Students should not be dropped off before their scheduled session start time unless prior arrangements have been made with Bright Futures staff.

  • Transportation: Parents and guardians are solely responsible for the student's transportation to and from sessions. Tutors do not transport students under any circumstances.

  • Student release: Students will only be released to the parent, guardian, or authorized adults listed on the enrollment form. Bright Futures staff will not release a student to any individual not on the authorized list without prior written or verbal authorization from the parent or guardian.

11. Photos & Marketing

Bright Futures may occasionally photograph or record sessions or events for use in marketing and promotional materials, including our website and social media channels.

 

Photo and media consent is determined by the Parent or Guardian's selection on the enrollment form. Bright Futures will honor the consent choice indicated at enrollment. If a family's preference changes at any time, written notice may be submitted to info@mybrightfuturestutoring.com and the updated preference will be applied going forward.

 

12. Independent Contractor Disclosure

Tutors providing services through Bright Futures may be employees or independent contractors. Regardless of classification, all tutors are selected, screened, background checked, trained, and supervised according to Bright Futures standards to ensure a consistent and high-quality experience for every student.

 

13. Illness Policy

To protect the health of all students and staff, students should not attend in-office sessions if they are experiencing any of the following:

  • Fever (100.4°F or higher)

  • Vomiting or diarrhea within the past 24 hours

  • Symptoms of a contagious illness (e.g., strep throat, pink eye, flu)

 

If a student is ill, please notify Bright Futures as soon as possible. We will work with your family to reschedule the session. Illness-related cancellations are considered compassion exceptions and will not result in a late-cancellation fee (see Section 3).

 

14. Emergency Medical Care

If a student becomes ill or injured during a session, Bright Futures staff will:

  • Attempt to contact the parent or guardian immediately

  • Contact the emergency contact on file if the parent or guardian cannot be reached

  • Call 911 if the situation requires emergency medical attention

 

Bright Futures staff are not medical professionals and are not responsible for providing medical care. By enrolling, the Client authorizes Bright Futures to seek emergency medical assistance on behalf of the student if necessary.

 

15. Online Tutoring & Technology

Bright Futures offers tutoring sessions via video conferencing platforms including, but not limited to, Zoom and Google Meet. Session links will be provided by the assigned tutor or Bright Futures staff prior to the scheduled session.

 

Technology Requirements

For online sessions, the Client is responsible for ensuring:

  • A reliable internet connection sufficient for video conferencing

  • A working microphone and camera must remain on throughout the session. Video participation is required for all online tutoring sessions to ensure an effective and engaged learning environment.

  • A reasonably quiet, distraction-free workspace for the student

 

Bright Futures is not responsible for session interruptions, delays, or quality issues caused by the Client's internet connection, equipment, or technical environment. If a session is significantly disrupted due to the Client's technology, the session fee may still apply. If the disruption is on Bright Futures' end, the session will be rescheduled at no charge.

 

Dress Code

Students are expected to dress for online sessions as they would for a school day — in appropriate, school-suitable attire. This standard helps maintain a respectful and productive learning environment for both the student and tutor.

 

Parental Presence for Elementary Students

For students in grades K–5, a parent or guardian is required to be present in the home during online sessions. They do not need to be in the room at all times but must be available and reachable in the event of a technical issue, behavioral concern, or any other situation that may arise during the session.

 

For students in grades 6 and above, a parent or guardian is not required to be present, though it is always welcome.

 

16. Homework & Academic Integrity

Tutors at Bright Futures provide instruction, guidance, feedback, and academic support to help students build skills and understanding. Tutors will not complete homework assignments, tests, essays, or other graded work on behalf of students. Bright Futures is committed to supporting genuine student learning and academic integrity.

 

17. Test Prep Disclaimer

Bright Futures offers preparation support for the ACT, SAT, and other standardized tests. The ACT, SAT, and other standardized testing organizations periodically change testing formats, content, scoring, and policies. Bright Futures makes reasonable efforts to keep prep materials current but cannot guarantee that all content reflects the most recent test format at the time of a student's exam. Clients are encouraged to review the latest test guidelines directly with the relevant testing organization.

 

18. Intellectual Property

All worksheets, lesson plans, practice tests, instructional materials, and other educational resources created or provided by Bright Futures remain the exclusive property of Bright Futures Tutoring LLC. These materials may not be copied, distributed, resold, or used for commercial purposes without prior written permission from Bright Futures. Materials are provided for the enrolled student's personal academic use only.

 

19. Session Recording

Sessions may not be audio or video recorded by the Client, student, or any third party without prior written permission from Bright Futures. This policy is in place to protect the privacy of tutors, students, and staff. Any unauthorized recording may result in immediate termination of services.

 

20. Accessibility & Learning Accommodations

Bright Futures is committed to supporting every student's unique learning needs. To help us provide the most effective tutoring experience, families are encouraged to notify Bright Futures at enrollment — or as soon as information becomes available — of any:

  • Individualized Education Programs (IEPs)

  • 504 plans or formal accommodations

  • Diagnosed or suspected learning differences (e.g., dyslexia, ADHD, processing disorders)

  • Preferred learning styles, sensory considerations, or other factors that impact learning

 

This information will be shared with the assigned tutor and used solely to better support the student. It will be kept confidential in accordance with Section 8 of these Terms.

 

21. Satisfaction Policy

Bright Futures is dedicated to finding the right fit for every student. If a tutor is not the right match for your student's needs, learning style, or personality, please let us know. We will gladly work with your family to identify another qualified tutor at no additional charge. Your student's success and comfort are our priority.

 

22. Independent & Self-Scheduling Students

Bright Futures recognizes that some enrolled students — particularly high school juniors and seniors — may drive themselves to sessions and manage their own scheduling with parent or guardian approval. The following terms apply in these situations:

 

  • Parental authorization: A parent or guardian may authorize their student to independently schedule, reschedule, or cancel sessions through the Bright Futures client portal. This authorization must be indicated on the enrollment form. Any scheduling action taken by an authorized student is considered approved by the parent or guardian on file.

  • Billing responsibility: Regardless of who schedules or cancels a session, the parent or guardian listed on the enrollment form remains the responsible billing party. All charges — including late-cancellation fees resulting from student-initiated cancellations — will be applied to the account on file.

  • Cancellation policy: The 24-hour cancellation policy (Section 3) applies equally to sessions scheduled or cancelled by the student. Late-cancellation fees apply to the parent or guardian account regardless of who initiated the cancellation.

  • Transportation & supervision: Students who drive themselves to sessions are responsible for their own transportation and are not subject to the Late Pickup Policy (Section 9). Self-transporting students are released at the conclusion of their session and may leave independently.

  • Communication: For self-scheduling students, Bright Futures may communicate directly with the student regarding session logistics and scheduling. Parents or guardians will continue to receive billing communications and may request progress updates at any time.

 

If a student's self-scheduling authorization needs to be added, updated, or removed, the parent or guardian may contact Bright Futures at info@mybrightfuturestutoring.com or 612-208-9022.

 

23. Force Majeure

Bright Futures shall not be held liable for any failure or delay in providing services caused by circumstances beyond our reasonable control, including but not limited to:

  • Severe weather events or natural disasters

  • Illness outbreaks or public health emergencies

  • Power outages or facility closures

  • Internet or technology failures beyond Bright Futures' control

  • Government-mandated restrictions or orders

  • Building emergencies or evacuations

 

In such circumstances, Bright Futures will make reasonable efforts to notify affected families promptly and to reschedule impacted sessions at no charge.

 

24. Termination of Services

  • By the Client: Services may be discontinued at any time with 7 days' written notice to Bright Futures. Sessions already completed will be billed at the regular rate. Any prepaid, unused credits will be refunded minus outstanding balances.

  • By Bright Futures: We reserve the right to discontinue services with 7 days' notice for non-payment, chronic late cancellations, or conduct concerns, or immediately in the event of a safety issue.

 

25. No Guarantee of Outcomes

Bright Futures Tutoring provides academic support services with the goal of helping students improve their skills and confidence. However, we make no guarantee of specific academic outcomes, test score improvements, grade changes, or college admission results. Results depend on many factors including the student's effort, consistency of attendance, and individual learning profile.

 

26. Limitation of Liability

To the fullest extent permitted by law, Bright Futures Tutoring LLC shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to the services provided, including but not limited to academic outcomes, test scores, or college admission decisions.

 

Bright Futures' total liability to the Client for any claim arising under these Terms shall not exceed the total fees paid by the Client in the 30 days immediately preceding the event giving rise to the claim.

 

27. Website Use

Your use of mybrightfuturestutoring.com is subject to the following:

  • All content on this website — including text, images, and graphics — is the property of Bright Futures Tutoring LLC and may not be reproduced without written permission.

  • Bright Futures is not responsible for the content of any third-party websites linked from our site.

  • We reserve the right to modify or discontinue website features at any time without notice.

 

28. Updates to These Terms

Bright Futures may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page and notify active Clients by email at least 14 days before changes take effect. Continued enrollment or use of our website after the effective date constitutes acceptance of the updated Terms.

 

29. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Minnesota.

 

Before initiating any legal proceedings, the parties agree to make a good-faith effort to resolve any dispute through informal discussions. Either party may initiate this process by providing written notice of the dispute to the other party, after which both parties will have 30 days to attempt resolution informally.

 

If informal resolution is unsuccessful, any disputes arising under these Terms shall be resolved in the courts of Hennepin County, Minnesota.
